B-9.01Broadcasting ActSI/88-1232013012820051014BROADCASTING ACTOrder Declining to Set Aside or to Refer Back to the CRTC a Decision Respecting New Brunswick Broadcasting Company Ltd.Whereas the Canadian Radio-television and Telecommunications Commission rendered Decision CRTC 88-376 on June 3, 1988, approving the application of New Brunswick Broadcasting Company Ltd. for an amendment of its broadcasting licences for English-language television broadcasting undertakings at Fredericton and Saint John, New Brunswick and denying New Brunswick Broadcasting Company Ltd.'s application for an amendment of its broadcasting licence for an English-language television broadcasting undertaking at Halifax, Nova Scotia;Whereas subsequent to the rendering of Decision CRTC 88-376 the Governor in Council received a petition requesting that the said Decision be set aside;And Whereas the Governor in Council, having considered the petition, is of the opinion that it is not in the public interest to set aside or to refer back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing by the Commission the said Decision CRTC 88-376.Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Communications, pursuant to section 23 of the Broadcasting Act hereby declines to set aside or to refer back to the Canadian Radio-television and Telecommunications Commission for reconsideration and hearing Decision CRTC 88-376 of June 3, 1988.
